On November 14, 2023, this Court granted Appellant Anthony Whitehurst's Second Motion to Extend Time to File [His] Appellant's Brief, and extended Appellant's deadline to file his brief to November 30, 2023. Appellant did not file his brief on the due date. On December 28, 2023, we sent Appellant a letter informing him that his appeal may be dismissed for want of prosecution if within ten days, he did not file his brief or a motion to extend time to file his brief. On January 9, 2024, Appellant filed a Third Motion Extend Time to File [His] Appellant's Brief. Appellee objected and again moved to dismiss Appellant's appeal as moot on the ground that "Appellant is no longer in possession of the property."
On January 23, 2024, Appellant filed a Motion to Abate the Appeal. Appellant's Motion to Abate the Appeal is denied.
Appellee's motions to dismiss the appeal as moot remain under consideration.
Appellant is granted one last extension of 20 days to file his appellate brief, making his brief due on March 4, 2024. No further extensions will be granted.
This appeal may be dismissed for want of prosecution, without further notice, if Appellant does not file his brief by March 4, 2024. See Tex. R. App. P. 38.6(d), 38.8(a)(1).
