White v. State

District Court of Appeal of Florida, Fifth District
May 3, 1996
672 So. 2d 890 (Fla. Dist. Ct. App. 1996)

Opinion

No. 95-2631.

May 3, 1996.

Appeal from the Circuit Court for Volusia County; R. Michael Hutcheson, Judge.

James B. Gibson, Public Defender, and James T. Cook, Assistant Public Defender, Daytona Beach, for Appellant.

Robert A. Butterworth, Attorney General, Tallahassee, and Wesley Heidt, Assistant Attorney General, Daytona Beach, for Appellee.

We affirm the judgment and sentence in this Anders appeal, except for the assessment of $250 for a public defender's lien. Appellant was not told of his right to contest the amount, so the lien must be stricken without prejudice to reimpose it after compliance with Florida Rule of Criminal Procedure 3.720 (d)(1).

Anders v. California, 386 U.S. 738, 87 S.Ct. 1396, 18 L.Ed.2d 493 (1967).

AFFIRMED; LIEN STRICKEN.

DAUKSCH, COBB and GOSHORN, JJ., concur.
