White v. State

District Court of Appeal of Florida, First District
Jun 12, 1997
695 So. 2d 499 (Fla. Dist. Ct. App. 1997)

Opinion

Case No. 96-878

Opinion filed June 12, 1997.

Circuit Court for Bay County. Dedee Costello, Judge.

Nancy A. Daniels, Public Defender; Carl S. McGinnes, Assistant Public Defender, Tallahassee, for Appellant.

Robert A. Butterworth, Attorney General; Amelia L. Beisner, Assistant Attorney General, Tallahassee, for Appellee.

We affirm the appellant's conviction and sentence but remand the case for the correction of a scrivener's error in the probation order. The order should reflect that the appellant was convicted by a jury of the lesser included offense of burglary of a dwelling, and not that he entered a nolo contendere plea to the charge of burglary of a dwelling with an assault.

MINER, LAWRENCE and PADOVANO, JJ., CONCUR.
