Petitioner's petition for writ of habeas corpus is treated as a petition alleging ineffective assistance of appellate counsel. The mandate in 2D09–4439 having issued January 8, 2011, this petition alleging ineffective assistance of appellate counsel is dismissed as untimely. SeeFla. R.App. P. 9.141(d)(5).
