January 12, 1945.

Present — Martin, P.J., Townley, Glennon, Untermyer and Dore, JJ.; Dore, J., dissents in part to the extent of voting to retain in the first decretal clause of the order the words: "which shall not be libelous". Settle order on notice incorporating a provision for the mailing of the matter supplied by plaintiff within twenty-four hours after receipt thereof.


Order so far as appealed from, reversed, with twenty dollars costs and disbursements to the appellant. No opinion.
