Upon consideration of the appellant's response to the Court's order of October 3,2002, the Court has determined that the appeal was not timely filed. Accordingly, the appeal is hereby dismissed for lack of jurisdiction. Furthermore, the appellant's motion to relinquish jurisdiction, filed on October 18, 2002, is denied as moot.

DISMISSED.
