ORDER GRANTING DEFENDANTS' MOTION TO DISMISS, VACATING HEARING DATE, AND CLOSING CASE


This is a civil rights case filed pro se by a former inmate of the Monterey County Jail. Defendant Rivera moved to dismiss the claims against her for failure to prosecute, and defendants Monterey County, Deputy Baird, and Deputy Melton joined in the motion. The Court, in an effort to determine if plaintiff desired to pursue this case, entered an order setting a deadline of April 30, 2003, for plaintiff to file an opposition. That order has not been returned as undeliverable, so the Court must assume that plaintiff received it. He has not filed an opposition.

Defendants' motion to dismiss for failure to prosecute (doc 66) is GRANTED. This case is DISMISSED with prejudice. The hearing date for this motion is VACATED. The clerk shall close the file.

SO ORDERED.
