This case was stricken from the Court's September 12, 2022, Atlanta, Georgia trial session and jurisdiction was retained by the undersigned.
On February 6, 2023, the Commissioner filed a motion to dismiss for lack of prosecution requesting that the Court enter a decision finding that there is a deficiency due from petitioner Ortavius Kharece White for tax year 2018 in the amount of $5,245.00 and that no penalty is due under I.R.C. § 6662(a). We will direct Mr. White to file a response to the motion. Accordingly, it is
ORDERED that, on or before March 16, 2023, Mr. White shall file a response to the Commissioner's motion to dismiss for lack of prosecution. If Mr. White fails to comply with this Order, the Court is inclined to grant the motion and enter a decision against him (absent further action). 1
