Court of Appeals of Texas, Fifth District, Dallas
Jun 9, 2009
No. 05-08-01728-CV (Tex. App. Jun. 9, 2009)

Opinion

No. 05-08-01728-CV

Opinion issued June 9, 2009.

On Appeal from the 255th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 01-8404-S.

Before Justices FITZGERALD, LANG, and FILLMORE.

MEMORANDUM OPINION

On May 15, 2009, this Court ordered the Dallas County District Clerk to file, within fifteen days, either the clerk's record or written verification that appellant has not paid for the record. On that same date, we received correspondence from the District Clerk that appellant has not paid for the record. By letter dated May 19, 2009, we notified appellant that the District Clerk said appellant had not paid for the clerk's record. We directed appellant to file, within ten days, written verification that payment had been made for the clerk's record. Both the May 15, 2009 order and the May 19, 2009 letter warned appellant that the appeal would be dismissed if we did not receive verification she had paid for the clerk's record. To date, appellant has not responded to either the order or the letter. Accordingly, we dismiss the appeal for want of prosecution. See Tex. R. App. P. 37.3(b), 42.3(c).
