MOTION TO DISMISS


On September 14, 1977, we issued an order to the plaintiff-appellant, David R. Wheeler, to show cause, by brief only, on or before September 30, 1977, why his appeal in the above captioned suit should not be dismissed due to his failure to timely file his appeal bond. The appellant has not answered the order.

The appellant's appeal is therefore dismissed due to his failure to timely file his appeal bond.

APPEAL DISMISSED.
