Opinion

No. 183 2012.

2012-04-26

Thomas WHEELER, Defendant Below–Appellant, v. STATE of Delaware, Plaintiff Below–Appellee.

Court Below—Court of Common Pleas of the State of Delaware, in and for Kent County, Cr. ID 0907006004.

ORDER

JACK B. JACOBS, Justice.

This 26th day of April 2012, it appears to the Court that, on April 10, 2012, the Clerk issued a notice to appellant to show cause why this appeal should not be dismissed for this Court's lack of jurisdiction to hear an appeal directly from the Court of Common Pleas. The appellant has failed to respond to the notice to show cause within the required ten-day period; therefore, dismissal of this action is deemed to be unopposed.

NOW, THEREFORE, IT IS HEREBY ORDERED, pursuant to Supreme Court Rules 3(b) and 29(b), that the within appeal is DISMISSED.
