Judgment of the Municipal Court reversed and new trial ordered, costs to abide the event, on the ground that it was not shown that the defendant was in any way responsible for the falling of the brick, as the brickwork was being done by a contractor. Jenks, Hooker, Gaynor, Rich and Miller, JJ., concurred.
