ORDER
On January 13, 2016, Appellee Betsy Mecom asked this court for permission to supplement the record with documents that were not filed with the trial court, see TEX. R. CIV. P. 191.4(a)(1), but that may be filed if "necessary for a proceeding in an appellate court," see id. R. 191.4(c)(3). In response, Appellant noted all the documents Appellee requested were filed with the trial court, and all but one are already included in the clerk's record.
For documents filed with the trial court but not contained in the clerk's record, "any party may by letter direct the trial court clerk to prepare, certify, and file in the appellate court a supplement containing the omitted item[s]." TEX. R. APP. P. 34.5(c)(1). If Appellee elects to supplement the record with documents that are already included in the clerk's record, Appellee must pay the costs to prepare, certify, and file those redundant documents. See id. R. 34.5(b)(3).
Appellee's January 13, 2016 motion is MOOT.
