Jan 31, 1949
38 So. 2d 313 (Fla. 1949)

Opinion

December 3, 1948. Rehearing Denied January 31, 1949.

Appeal from Circuit Court, Pinellas County; John U. Bird, Judge.

Joseph W. Nichols and M.H. Jones, both of Clearwater, for appellant.

J. Tom Watson, Atty. Gen., and Reeves Bowen, Asst. Atty. Gen., for appellee.

Affirmed.

TERRELL, CHAPMAN, ADAMS, SEBRING, BARNS, and HOBSON, JJ., concur.

I dissent because of the conviction that the State failed to prove beyond a reasonable doubt that the appellant killed the deceased by "cutting and stabbing her with some sharp instrument" as alleged in the conviction.
