An appeal having been taken to this Court from an order of the Supreme Court, New York County, entered on or about August 11, 2020, said appeal having been perfected, And plaintiffs-appellants having moved for this Court for an order taking judicial notice of the Federal Employer Identification Numbers of non-party Westaub Inc. and plaintiff-appellant Westaub II LLC, as indicated on government documents created by the Internal Revenue Service, and listed in Exhibits 1-3 of the Downes affidavit submitted in support of the within motion, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of taking judicial notice of the cited Employer Identification Numbers without prejudice to the arguments made in the briefs on appeal.
