West v. State

District Court of Appeal of Florida, Second District
Oct 22, 1993
625 So. 2d 975 (Fla. Dist. Ct. App. 1993)

Opinion

No. 92-02152.

October 22, 1993.

Appeal from the Circuit Court, Hillsborough County, Donald C. Evans, J.

James Marion Moorman, Public Defender, and Timothy J. Ferreri, Asst. Public Defender, Bartow, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Brenda S. Taylor, Asst. Atty. Gen., Tampa, for appellee.

We affirm the order revoking the appellant's probation. We strike from the written order, however, the finding that the condition requiring payment of costs of supervision was violated. The judge did not pronounce that the appellant had violated this condition, nor does the evidence support such a finding.

CAMPBELL, A.C.J., and HALL and THREADGILL, JJ., concur.
