ORDER

Pursuant to MCR 7.216(A)(7), the Court directs that an administrative hearing under MCL 257.322 shall be held within 35 days of the date of the Clerk's certification of this order. The delayed application for leave to appeal otherwise is DENIED for lack of merit in the grounds presented.

This order is to have immediate effect. MCR 7.215(F)(2). The Court retains no further jurisdiction.

Jansen, J., would grant the delayed application for leave to appeal, and stay the suspension of the petitioner's driving privileges. The administrative agency should not have proceeded with a hearing while petitioner was seeking leave to appeal in this Court.
