BEVERLY WEST PETITIONER v. HONORABLE SCOTT JACKSON, CARROL COUNTY CIRCUIT COURT RESPONDENT

APPEAL FROM THE CARROL COUNTY CIRCUIT COURT, EASTERN DIVISION COUNTY CIRCUIT COURT
[08E-CV-16-106] HONORABLE CHARLES SCOTT JACKSON, JUDGE DISSENTING OPINION. JOSEPHINE LINKER HART, Associate Justice

I dissent. West alleges that the circuit judge has filed an order to the effect that she is no longer allowed to file any documents in her case, and neither the circuit judge nor any of the other parties to the case has filed a response. Access to the courts is one of the pillars of our society. While there is surely more to the story than what has been alleged in West's petition, this court should seriously address any allegation of infringement upon this fundamental right. Instead of denying West's petition at this juncture, I would require that the record be supplemented with the circuit judge's order prohibiting West from filing any documents in her case, as well as confirmation that the circuit judge was served with West's petition, and then rule accordingly.
