Petitioner Neil W. having moved for leave to appeal to this Court from a non-final order of the Family Court, New York County, entered on or about June 28, 2018, a stay of that order pending hearing and determination of the appeal, an order remanding the child to the said father's custody, Now, upon reading and filing the papers with respect to the motion, including an affidavit submitted by petitioner Neal W. dated August 27, 2018, and due deliberation having been had thereon, It is ordered that the motion by petitioner father is deemed withdrawn in accordance with the aforementioned affidavit.
