Opinion

93 Civ. 8948 (LAK)

July 21, 2000

ORDER

This action has been stayed pending the outcome of plaintiff's contempt motion in Milburn v. Coughlin, 79 Civ. 5077 (RJW) before Judge Ward.

The Court is in receipt of a letter to both Judge Ward and to the undersigned, captioned in both cases, in which plaintiff makes further complaints concerning DOCS' response to his alleged medical needs. As there is no suggestion in the letter that plaintiff's current complaints include a claim of violation of the Milburn decree, the Court will treat the letter as a motion for interlocutory relief in this case. Accordingly, the defendants shall show cause, on or before August 4, 2000, why an order should not be entered directing DOCS to furnish plaintiff with a new catheter for every required use and to return or replace the wheelchair that plaintiff claims was confiscated from him.

SO ORDERED.
