DONNA WEST APPELLANT v. AMERICAN HOMES 4 RENT PROPERTIES TWO, LLC APPELLEE

FROM COUNTY COURT AT LAW NO. 1 OF TARRANT COUNTY
TRIAL COURT NO. 2015-004840-1 MEMORANDUM OPINIONAND JUDGMENT

On October 13, 2015, Appellant Donna West perfected an appeal from a judgment entered on October 8, 2015. The clerk's record was filed on February 4, 2016. The reporter's record was filed on February 5, 2016. West's brief was due March 7, 2016.

On February 26, 2016, West filed her first motion for extension of time to file her brief, requesting an extension until April 20, 2016. This court granted her motion.

On April 13, 2016, West filed her second motion for extension of time to file her brief, requesting an extension until May 13, 2015. This court granted her motion.

On May 11, 2016, West filed her third motion for extension of time to file her brief, requesting an extension until May 20, 2016. This court granted her motion. The order granting her motion stated that "NO FURTHER EXTENSIONS WILL BE GRANTED."

On May 23, 2016, West filed her fourth motion for extension of time to file her brief, requesting an extension until June 20, 2016. This court denied her motion on May 31, 2016. In the order denying her motion, this court ordered her to file her brief on or before June 6, 2016, and stated that if she failed to do so, her appeal would be dismissed for want of prosecution. See Tex. R. App. P. 38.8(a), 42.3(b). West did not file a brief.

On June 29, 2016, West filed her fifth motion for extension of time to file her brief, requesting an extension until July 19, 2016. This motion is denied.

Because West has had five months to prepare and file her brief and has failed to do so, we dismiss her appeal for want of prosecution. See Tex. R. App. P. 38.8(a), 42.3(b), 43.2(f). In light of our disposition, "Appellee's Motion to Dismiss Appeal for Failure to Prosecute" is denied as moot.

Appellant Donna West shall pay all costs of this appeal, for which let execution issue. See Tex. R. App. P. 43.4
