WEST-REEVES, LTD., Appellant v. JAMES DAVID HORTON, KIMBERLY JANE HORTON, AMANDA NICOLE HORTON, TIMOTHY DAVID HORTON, JAMES CHRISTOPHER HORTON AND JEFFREY MICHAEL HORTON, Appellees

From the 40th District Court

Ellis County, Texas

Trial Court No. 77623

MEMORANDUM OPINION

Appellant, West-Reeves, Ltd., filed an unopposed motion to dismiss the appeal. See TEX. R. APP. P. 42.1(a)(1). The parties have entered into a settlement agreement, and West-Reeves, Ltd. no longer wishes to pursue the appeal. Dismissal of this appeal would not prevent a party from seeking relief to which it would otherwise be entitled. The motion is granted, and the appeal is dismissed. Appellant's motion for immediate issuance of mandate is also granted. TEX. R. APP. P. 18.1 (c).
