DONNA WESSELLS-ESKRIDGE, Respondent Below, Appellant, v. MICHAEL ESKRIDGE, Petitioner Below, Appellee. No. 13, 2002 In the Supreme Court of the State of Delaware. March 5, 2002

E. NORMAN VEASEY, Chief Justice:

ORDER

This 5th day of March 2002, it appears to the Court that the Assistant Clerk issued a notice on January 31, 2002 directing Donna Wessells-Eskridge to show cause why this appeal should not be dismissed, pursuant to Supreme Court Rule 29(b), for her failure to diligently prosecute the appeal by failing to pay to this Court the filing fee for this appeal. Wessells-Eskridge has failed to respond to the notice to show cause within the required ten-day period; therefore, dismissal of this action is deemed to be unopposed.

NOW, THEREFORE, IT IS ORDERED, pursuant to Supreme Court Rules 3(b) and 29(b), that the within appeal is DISMISSED.
