Opinion

December, 1934.

Order granting defendant's motion to suspend payment of alimony under a judgment in a separation action until plaintiff joined in the execution of a mortgage upon certain property of the defendant reversed on the law and the facts, with ten dollars costs and disbursements, and motion denied, with ten dollars costs. In our opinion, the making of the order appealed from was an abuse of discretion. Lazansky, P.J., Young, Scudder, Tompkins and Davis, JJ., concur.
