PRESENT:

Appellant having moved, upon the return of an order to show cause granted by the Honorable Tracey A. Bannister on November 4, 2020, for a stay of all proceedings to enforce an order of the Supreme Court, Erie County, dated August 19, 2020, pending the hearing and determination of the appeal taken herein,

Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted and all proceedings to enforce the order appealed from are hereby stayed pursuant to CPLR 5519 (c) pending the hearing and determination of the appeal, on the condition that the appeal is perfected on or before January 11, 2021.
