Appellant's brief is overdue. Appellant's brief was originally due November 1, 2023. On November 1, 2023, this Court granted appellant's motion for extension of time to file the brief and ordered the brief filed by December 1, 2023. On December 4, 2023, we notified appellant's counsel, Mark Lassiter, that the brief was overdue, and we directed counsel to file appellant's brief and a motion for extension of time to file the brief within ten days. As of the date of this order neither the brief nor another motion for extension of time to file the brief have been filed.

We ORDER Mr. Lassiter to file appellant's brief and motion for extension of time to file the brief on or before JANUARY 16, 2024. If appellant's brief and a motion for extension of time to file the brief are not filed by that date, this appeal may be abated for the trial court to make findings in accordance with Rule of Appellate Procedure 38.8. See TEX. R. APP. P. 38.8(b)(2).
