The reporter's record was originally due on July 15, 2024. No notification of late record regarding the reporter's record was timely filed, and we issued an order requiring the filing of a notification of late record or the reporter's record by August 8, 2024. On August 7, 2024, Ester Delgado filed a notification of late record stating that she was not the court reporter for the June 5, 2024 hearing on appellant's motion for reconsideration.
It is therefore ORDERED that appellant provide written proof to this court on or before August 26, 2024 that appellant has requested the court reporter to prepare the reporter's record, which request must designate the portions of the proceedings and the exhibits to be included. See Tex. R. App. P. 34.6(b)(1).
It is further ORDERED that appellant provide written proof to this court on or before August 26, 2024 that either (1) the reporter's fee has been paid or arrangements have been made to pay the reporter's fee; or (2) appellant is entitled to appeal without paying the reporter's fee.
The reporter's record must be filed no later than September 3,2024. If appellant fails to respond within the time provided, appellant's brief will be due on or before September 13, 2024, and the court will consider only those issues or points raised in appellant's brief that do not require a reporter's record for a decision. See id. at R. 37.3(c).
