The reporter's record was originally due September 9, 2024, but was not filed. On September 16, 2024, Ms. Esther Delgado filed a notice of late record representing she was not the court reporter on the dates the records were requested.
We ORDER appellant to provide written proof to this court by September 30, 2024 that the appellant has requested the court reporter to prepare the reporter's record, which request must designate the portions of the proceedings and the exhibits to be included. See TEX. R. APP. P. 34.6(b)(1). If Ms. Delgado is not the court reporter responsible for preparing the reporter's record in this case, we further ORDER appellant to notify this court of the identity of the correct court reporter. The reporter's record must be filed no later than thirty days after the date appellant's written proof is filed with this court.
If appellant fails to request the record in writing, appellant's brief will be due within thirty days of the date of this order, and the court will consider only those issues or points raised in appellant's brief that do not require a reporter's record for a decision. See TEX. R. APP. P. 37.3(C).
