Upon the papers filed in support of the motion and no papers having been filed in opposition or in relation thereto, it is

ORDERED that the branch of the motion which is for leave to serve and file a supplemental record is denied as unnecessary, as the parties stipulated to this relief (see 22 NYCRR 670.7[a][ii]); and it is further, ORDERED that the branch of the motion which is to extend the time to serve and file a brief is denied as academic, as the respondent's brief has been timely served and filed.
