Opinion

No. 04-16-00707-CV

06-12-2017

Stephen WELLINGTON, Appellant v. Carrie Lynn WELLINGTON, Appellee

From the 25th Judicial District Court, Guadalupe County, Texas
Trial Court No. 14-1769-CV
Honorable Robin V. Dwyer, Judge Presiding

ORDER

After appellant filed a suggestion of bankruptcy and notice of automatic stay, we abated this appeal and removed the appeal from the active docket of this court. While this appeal was abated, appellee's counsel filed a motion to withdraw because appellee did not retain counsel for this appeal. We took no action on the motion to withdraw.

Appellant has filed a notice showing the bankruptcy court has modified the automatic stay to permit this appeal to proceed. We therefore order that this appeal is reinstated on the active docket of this court. The record in this appeal was filed before we abated this appeal. Accordingly, we order appellant to file the appellant's brief by July 12, 2017.

We further order any objection appellee has to her counsel's motion to withdraw due by July 3, 2017. If no objection is filed, we may grant counsel's motion to withdraw without further notice and the appellee's brief due thirty days after the appellant's brief is filed. See TEX. R. APP. P. 38.6(b).

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 12th day of June, 2017.
