Opinion

B183585

12-11-2006

FINIS WELCH, Plaintiff and Appellant, v. OCEAN TOWERS HOUSING CORPORATION, Defendant and Respondent.

Marcin Barrera LLP and Gregory C. Bane for Plaintiff and Appellant. Tyre Kamins Katz Granof & Menes and Edmund S. Schaffer for Defendant and Respondent.

In case No. B181476, filed this day, we reversed the judgment entered in favor of Ocean Towers Housing Corporation, on Finis Welchs complaint.

In that case, the trial court also made an award of attorneys fees. Welch appealed that award, and Ocean Towers cross-appealed, contending that it was inadequate.

Given our disposition of the appeal of the judgment, we vacate the fees award and dismiss both the appeal and the cross appeal. Plaintiff to recover costs on appeal.

We concur:

TURNER, P. J.

MOSK, J.
