Weiss v. Tucker

Appellate Division of the Supreme Court of New York, First Department
Jan 1, 1928
222 App. Div. 801 (N.Y. App. Div. 1928)

Opinion

January, 1928

Present — Dowling, P.J., Finch, McAvoy, Martin and O'Malley, JJ.

Order reversed, with ten dollars costs and disbursements, and motion denied, with ten dollars costs, upon the ground that the facts shown by the plaintiffs do not justify an injunction pendente lite, which would bear so heavily upon the defendants, and would inconvenience the plaintiffs so little, considering the short time involved until the trial.
