Action to recover broker's commissions. Appeal from judgment dismissing the complaint at the close of plaintiff's case. Judgment of the County Court of Nassau county reversed on the law and a new trial ordered, costs to appellant to abide the event. The plaintiff made out a cause of action. Lazansky, P.J., Young, Hagarty, Carswell and Tompkins, JJ., concur.
