This case is currently calendared on the Court's New York, New York, trial session, scheduled to begin April 25, 2022.

On February 24, 2022, petitioner Sheila M. Weir filed a motion for leave to file notice of proceeding in bankruptcy and lodged the notice of proceeding in bankruptcy. On March 16, 2022, the Commissioner filed a response to the motion in which he asserts that Ms. Weir has no active case bankruptcy proceeding since the Bankruptcy Court closed Ms. Weir's case in October 2021. The Commissioner further explains that he expects to provide Ms. Weir with decision documents proposing that she has no remaining liabilities at issue for tax year 2008 and 2009. After due consideration, it is

ORDERED that Ms. Weir's motion for leave to file notice of proceeding in bankruptcy is denied. 1
