DECISION & ORDER ON MOTION

Motion by appellant for leave to appeal to the Appellate Division from a decision and order on motion of this court dated October 24, 2016, which denied appellant's motion, in effect, to vacate a decision and order on motion of this court dated April 21, 2016, which dismissed an appeal from a final judgment of the Civil Court of the City of New York, Kings County, entered March 17, 2014.

Upon the papers filed in support of the motion and no papers having been filed in opposition thereto, it is

ORDERED that the motion is denied.
