Opinion filed May 27, 1942 Rehearing denied June 12, 1942

NEW TRIAL, § 44as to inadequate damages. Where it appeared that plaintiff in crossing the street walked into side of defendant's car and was severely injured, and she had a verdict and judgment for $300, and defendant did not seek any relief from the judgment, the judgment would be allowed to stand and a new trial for inadequate damages denied.

Appeal from Superior Court of Cook county; Hon. GROVER C. NIEMEYER, presiding.

Judgment affirmed. Heard in third division, first district, this court at April term, 1942.
