This case is calendared for trial at the Court's Trial Session in Cleveland, Ohio set to commence on November 7, 2022.

On August 25, 2022, the parties filed with the Court a Proposed Stipulated Decision (Index No. 8). Upon the Court's review, it appeared that Proposed Stipulated Decision did not address the I.R.C. § 6662(a) proposed penalty. The Court contacted respondent's counsel, who informed the Court that the parties would amend the Decision and refile the document with the Court. On October 11, 2022, the parties filed an amended Proposed Stipulated Decision (Index No. 9) which included the I.R.C. § 6662(a) penalty.

Upon due consideration, and for cause, it is

ORDERED that the parties' Proposed Stipulated Decision at Docket Index No. 8, filed with the Court on August 25, 2022, is stricken from the record of this case.
