ORDER

Appellant's notice of appeal was untimely filed and this Court dismissed the appeal for want of jurisdiction. Weems v. State, No. 10-17-00099-CR, 2017 Tex. App. LEXIS 3712 (App.—Waco Apr. 26, 2017, no pet.). Thereafter, appellant was granted an out of time appeal by the Court of Criminal Appeals.

Appellant's Motion to Transfer Appellate Record, which was filed by the Clerk of this Court on December 7, 2017, requests that we transfer the appellate record, filed in the dismissed appeal, to this new appeal. Appellant's motion is granted. The Clerk of this Court is ordered to file a copy of the appellate record filed in 10-17-00099-CR, Weems v. State, in this appeal, 10-17-00404-CR, Weems v. State.

Appellant's brief is due 30 days from the date of this order.
