ORDER


AND NOW, this 12th day of January, 2005, upon consideration of Plaintiff's "Motion for Admissions Request" (Document No. 31) and "Motion for First Request for Production of Documents" (Document No. 32), and it appearing to the Court that the said motions are in reality discovery requests which should not have been docketed as motions, it is hereby ORDERED that the motions are DENIED with leave to Plaintiff to properly re-serve them upon Defendants as Requests for Admissions and Requests for Production of Documents pursuant to Fed.R.Civ.P. Nos. 34 and 36.
