JUDGMENT


In accordance with the Order entered on this date, it is hereby ORDERED, ADJUDGED, and DECREED that the Petition for Writ of Habeas Corpus be denied, that the writ not issue and that this cause be and hereby is dismissed without prejudice so that Petitioner may pursue his unexhausted claims in state court.

ORDER

After due and proper consideration of all portions of this file deemed relevant to the issues raised, and there having been no objections filed, the recommendation of the Magistrate Judge made under 28 U.S.C. § 636 (b)(1)(B); 28 U.S.C. foil. § 2254, Rule 8(b)(1) and dated the 27th day of December, 2000 is ADOPTED as the opinion of this Court.
