Weaver v. Dr. Phillips, Inc.

District Court of Appeal of Florida, Fourth District
Apr 15, 1976
330 So. 2d 495 (Fla. Dist. Ct. App. 1976)

Opinion

No. 75-1116.

April 15, 1976.

Interlocutory appeal from Circuit Court, Orange County; William C. Gridley, Judge.

James W. Sears of Law Office of Carroll S. Barco, Orlando, for appellant.

Nicholas Yonclas of Akerman, Senterfitt, Eidson Wharton, Orlando, for appellee-Dr. Phillips, Inc.

The briefs and appendices in this cause demonstrate to us that the trial court was correct in granting the summary judgment appealed from. Appellant's statements in his affidavit create only a paper issue completely refuted by the guaranty agreement, the assignments of lease signed by the appellant, and the other parts of the record.

Accordingly, the summary judgment appealed from is affirmed.

CROSS, MAGER and DOWNEY, JJ., concur.
