On January 22, 2003, we ordered the parties to brief the question whether it was appropriate for this action to proceed without the presence of the County of Wayne as a party defendant. The County of Wayne has now filed a motion to be added as a party. The answers to the January 22 order and the motion to be added as a party defendant are considered. The motion is treated as a motion to intervene, and the motion is GRANTED. The County of Wayne shall file its answer to the complaint within 21 days of the date of this order.
