WAYMON SCOTT HARTWELL AND HHH FARMS, LLC, Appellants v. LONE STAR, PCA, Appellee

On Appeal from the 336th District Court Fannin County, Texas
Trial Court No. CV-17-42985 Before Morriss, C.J., Moseley and Burgess, JJ. ORDER

This is an interlocutory appeal from a trial court order granting temporary injunctive relief to the appellee, Lone Star, PCA. See TEX. CIV. PRAC. & REM. CODE § 51.014(a)(4) (West Supp. 2016). Lone Star filed a motion in this Court contending that the appellants, Waymon Scott Hartwell and HHH Farms, LLC, violated the trial court's temporary injunction and asking that the appellants be required to show cause why they should not be held in contempt for such violation.

Without considering the merits of Lone Star's motion and pursuant to Rule 29.4(a) of the Texas Rules of Appellate Procedure, we refer the motion to the trial court and instruct the court to hold an evidentiary hearing on the issues raised by the motion and to grant appropriate relief, should any such relief be warranted. See TEX. R. APP. P. 29.4(a).

IT IS SO ORDERED.
