Motion to dismiss appeal granted and appeal dismissed, without costs, upon the ground that the modification directed by the Appellate Division is not substantial in that it fails to present a question reviewable by the Court of Appeals (CPLR 5601, subd. [a], par. [iii], as amd. by L. 1969, ch. 999).

Cross motion for leave to appeal denied without prejudice to a motion for leave in conformity with the rules of this court (Rule IX [22 N.Y.CRR 500.9]; see, also, CPLR 5514, subd. [a]).
