Roy WATTERS, Appellant v. Mike LOPEZ and Tiffany Liesman, Appellee

From the 198th Judicial District Court, Kerr County, Texas
Trial Court No. 16616B
Honorable Rex Emerson, Judge Presiding

ORDER

Appellant seeks to appeal the trial court's order granting a bill of review and setting aside a prior judgment. A bill of review which sets aside a prior judgment but does not dispose of the case on the merits is interlocutory and not appealable. Jordan v. Jordan, 907 S.W.2d 471, 472 (Tex.1995); In re B.F.A., No. 04-04-00835-CV, 2005 WL 154258, at *1 (Tex. App.—San Antonio Jan. 26, 2005, no pet.) (mem. op.). It is therefore ORDERED that appellant show cause in writing within fifteen days from the date of this order why this appeal should not be dismissed for lack of jurisdiction. All other appellate deadlines are suspending pending our resolution of the jurisdictional issue.

Sandee Bryan Marion, Chief Justice

IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the said court on this 26th day of February, 2018.
