Dec 13, 1973
286 So. 2d 239 (Fla. Dist. Ct. App. 1973)

Opinion

No. U-106.

December 13, 1973.

Interlocutory Appeal from Circuit Court, Alachua County; R.A. Green, Jr., Judge.

Wayne P. Castello, Andrews Lewallen, Gainesville, for appellant.

William R. Burwell, Gainesville, for appellee.

Inasmuch as the plaintiff-appellee did not appeal the order of dismissal within thirty (30) days of the rendition thereof, the trial court lost jurisdiction to reinstate the complaint.

Florida Appellate Rules 3.2(b), 32 F.S.A.; and Kippy Corporation v. Colburn, 177 So.2d 193 (Fla. 1965).

The order granting the motion to set aside the order of dismissal is hereby reversed.

RAWLS, C.J., and JOHNSON and SPECTOR, JJ., concur.
