Opinion
No. 2:01-CV-0298.
July 21, 2004
Came this day for consideration the federal habeas corpus application filed by petitioner WILLIE MAE WATSON. On August 21, 2001, the United States Magistrate Judge issued a Report and Recommendation in this cause, recommending therein that the instant habeas application be dismissed as time barred. On September 10, 2001, petitioner filed objections to the Report and Recommendation. Respondent was subsequently ordered to respond to petitioner WATSON's petition as well as her objections to the recommendation of dismissal. Respondent filed his answer to the petition, and on June 25, 2004, the Magistrate Judge issued a Supplemental Report and Recommendation in this cause, recommending therein that petitioner's objections be overruled, and that the instant habeas application be dismissed as time barred. Petitioner has not filed any objections to the Supplemental Report and Recommendation.
The undersigned United States District Judge has made an independent examination of the record in this case. The Magistrate Judge's Report and Recommendation and Supplemental Report and Recommendation are hereby ADOPTED. Petitioner's objections to the Report and Recommendation are without merit and are hereby OVERRULED. Accordingly, the petition for a writ of habeas corpus is hereby DISMISSED as time barred.
LET JUDGMENT BE ENTERED ACCORDINGLY.
IT IS SO ORDERED.
