TRIAL PREPARATION CONFERENCE

APPEARANCES OF COUNSEL.

Court's opening remarks regarding resetting the trial preparation conference currently set for Friday, August 10, 2012, at 10:00 a.m. 3:11 p.m. Discussion regarding filing motions in limine and issues related to expert witnesses. 4:02 p.m. Discussion regarding taking preservation depositions of witnesses who are not available for trial. ORDERED: Preservation depositions of Harvey Bowman, Geoff Bacci, and Marvin Rash will be allowed to be taken prior to the jury trial. ORDERED: Plaintiffs objection to taking deposition of John Martyny shall be filed by Wednesday, June 27, 2012. ORDERED: Counsel shall make every attempt to have John Martyny testify in person at trial. ORDERED: Parties shall file stipulated facts not later than Friday, June 29, 2012. ORDERED: Plaintiffs are granted leave to file proposed motions in limine B and C. Motion in limine A is deferred pending the outcome of whether or not the documents related to Dr. Nestmann are disclosed to plaintiffs. ORDERED: Defendant Bird's Eye is denied leave to file proposed motions in limine. ORDERED: Defendant Gilster-Mary Lee Corp. and Kroger Defendants Motion for leave to file motions in limine regarding the Innova Model 1312 Photoacoustic multi-gas monitor is TAKEN UNDER ADVISEMENT. ORDERED: Defendant Gilster-Mary Lee Corp. and Kroger Defendants' are granted leave to file the following proposed motions in limine: 111A.1 and 111A.3. ORDERED: All motions in limine, approved and outlined by the Court, shall be filed not later than Wednesday, June 27, 2012. ORDERED: Responses to motions in limine shall be filed not later than Monday, July 9, 2012. ORDERED: Parties shall meet and confer regarding the issue of a settlement of a suit filed by plaintiff against other popcorn manufacturers. ORDERED: Defendants shall file a motion, related to settlement of a suit filed by plaintiff against other popcorn manufacturers, not later than Friday, June 27, 2012. ORDERED: Response to defendants motion, related to settlement as to some of the defendants, shall be filed not later than Monday, July 9, 2012.
