ORDER

PETER KELLY JUDGE

On January 5, 2024, appellant filed in this Court a statement of inability to afford payment of court costs. The Court ordered a special clerk's record containing any statement of inability filed in the trial court and any contest or order by the trial court granting the contest. The special clerk's record was filed on January 22, 2024 and it contained a statement of inability filed by appellant in the Justice Court on September 5, 2023. The special clerk's record contained no contest or order by the trial court.

Any statement of inability filed in the trial court carries forward so that the party is not required to file another statement of inability concerning appellate costs. See Tex. R. App. P. 20.1(b). The Clerk of this Court is directed to note in this case file that appellant is not responsible for payment of any filing fees or for the appellate record. See id.

It is so ORDERED.
