This evidence conclusively negates the fourth element of 1776’s fraud by nondisclosure claim. See id.; see also Watkins v. Rolling Frito-Lay Sales, LP, No. 05-16-00367-CV, 2017 WL 2665985, at *4 (Tex. App.—Dallas June 21, 2017, no pet.) (mem. op.) (affirming directed verdict where evidence conclusively negated required element). [49] Finally, we see no evidence that 1776 was damaged by acting without the undisclosed facts.
